If you’d like to take a look at the exact language of the proposed constitutional amendment relating to Georgia’s non compete agreements as it will appear on the ballot this week, we have it here for your convenience:

Proposed constitutional amendments
1. Allows competitive contracts to be enforced in Georgia courts.
House Resolution No. 178
Ga. L. 2010, p. 1260
“Shall the Constitution of Georgia be amended so as to make Georgia more economically competitive by authorizing legislation to uphold reasonable competitive agreements?”

Regardless of how you intend to vote, it is important to review your current contracts and update them to take into account the political climate that is rapidly changing how non compete agreements are viewed by the courts in Georgia.
